Quell - Terms
Quell — Terms of Use
The rules for using Quell, the no-contact and breakup recovery app. Please read them; by using the app you agree to them.
Quell is not therapy and not an emergency service. If you are thinking about harming yourself or someone else, or you are in danger, contact your local emergency number or a crisis line immediately.
1. This agreement
These Terms are an agreement between you and Kaya Apps ("we", "us"), the developer of Quell ("the app"). They apply together with our Privacy Policy (linked in the app and on the App Store page) and, for apps downloaded from the App Store, Apple's Licensed Application End User License Agreement. If these Terms and Apple's agreement conflict, these Terms apply to the extent the law allows.
2. Who may use Quell
You must be at least 16 years old, or the age of digital consent where you live if it is higher, to use the app.
3. What Quell does
Quell helps you keep no contact with someone and recover after a breakup or a hard relationship: a no-contact counter and milestones, daily check-ins, urge support tools (a timer, breathing, grounding, writing letters you never send), a 30-day program of short lessons, a journal, reminders, widgets, and Sage, an AI coach.
Quell never contacts anyone on your behalf and has no access to anyone else's accounts or messages.
4. Health, safety and Sage
- Quell offers general self-help and educational content. It is not psychotherapy, counselling, medical advice, diagnosis or treatment, and it does not replace a qualified professional. If you are struggling, please reach out to one.
- Sage is an artificial intelligence. Its replies are generated automatically, can be inaccurate, incomplete or inappropriate for your situation, and are not reviewed by a person. Use your own judgment; do not rely on Sage for decisions about your health, safety, legal or financial matters.
- Crisis resources shown in the app are provided for convenience. We do not operate them and cannot guarantee that they are available or up to date in your country.
- Decisions about contact with another person, including when there are children, shared homes or legal matters involved, are yours. If you are at risk from someone, contact local authorities or a domestic-violence service.
5. Your content
What you write in Quell (check-ins, journal, letters, reasons, messages to Sage) belongs to you. It is stored on your device as described in the Privacy Policy. When you use Sage you give us permission to process your messages only to generate replies and keep the service secure. You are responsible for backing up your device; if you delete the app without an iCloud backup, your entries cannot be recovered by us.
6. Free use and Quell Pro
Quell's core features are free, including the counter, check-ins, the urge timer, breathing, calling your safe person and crisis resources. Quell Pro is an auto-renewing subscription that unlocks Sage, the full 30-day program and extension packs, unlimited journal and vault, insights, hard-day alerts, more SOS tools and tracking more than one person. Prices are shown in the app before you buy, in your local currency.
- Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends if you started one.
- Subscriptions renew automatically for the same period unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple ID is charged for the renewal within 24 hours before the period ends.
- If a free trial is offered and you do not cancel at least 24 hours before it ends, it converts to a paid subscription. Any unused part of a trial is forfeited when you buy a subscription.
- You can manage or cancel your subscription at any time in your Apple ID settings. Cancelling stops the next renewal; it does not shorten the period you are already in.
- Refunds are handled by Apple under its own policy. If you have a legal right to withdraw from a purchase in your country, that right still applies.
- Sage has a fair-use daily limit to keep the service sustainable for everyone. We may adjust features, limits and prices for future periods; price changes follow Apple's rules and notifications.
7. What you agree not to do
- Use the app or Sage to harass, threaten or harm anyone, or to plan contacting someone who does not want contact with you.
- Try to make Sage produce harmful, illegal or abusive content, or to get around its safety rules or usage limits.
- Reverse engineer, copy, resell or interfere with the app or our servers, or access them by automated means or outside the genuine app.
- Use the app in breach of any law.
We may suspend access to Sage or other online features if you break these rules.
8. Our intellectual property
The app, its design, lessons, illustrations and texts belong to Kaya Apps or its licensors. We give you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, under these Terms and the App Store rules.
9. Disclaimers
The app is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free, or that it will achieve any particular emotional or relationship outcome. Some online features, such as Sage, depend on third-party services and an internet connection.
10. Limitation of liability
To the fullest extent the law allows, Kaya Apps will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, arising out of your use of the app. Where liability cannot be excluded, our total liability to you for all claims relating to the app is limited to the greater of the amount you paid for Quell in the twelve months before the claim arose, or 50 USD. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
11. Ending this agreement
You can stop using Quell at any time by deleting it; delete your data in the app first if you wish. We may stop offering the app or a feature; if we end a paid feature, any rights you have under consumer law or Apple's policies remain.
12. Governing law
These Terms are governed by the laws of Türkiye, and the courts of Türkiye have jurisdiction over disputes arising from them. If you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may also bring proceedings in your local courts.
13. Apple
- This agreement is between you and Kaya Apps only, not with Apple. Apple is not responsible for the app or its content.
- Kaya Apps, not Apple, is solely responsible for maintenance and support of the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Kaya Apps, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims.
- You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Changes to these Terms
We may update these Terms. We will post the new version here with a new date, and tell you in the app about significant changes. Continuing to use the app after a change means you accept it.
