Terms of Use

These Terms of Use (the "Terms") form an agreement between you and Furkan Kaya governing your use of the Headshot mobile application (the "App"). By downloading or using the App you accept these Terms. If you do not accept them, please do not use the App.

1. Licence

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on Apple devices that you own or control, as permitted by the App Store Terms of Service. This licence does not transfer ownership of the App or of any part of it, and it does not permit you to make the App available over a network where it could be used by several devices at once.

2. What the App does, and what it does not promise

The App produces stylised portraits from a photograph you supply, using artificial intelligence. Results are interpretations, not photographs of you: they may differ from your actual appearance, may contain artefacts, and vary with the quality of the photo you provide.

The App is not a substitute for professional photography, and results are not guaranteed to be accepted for identity documents, visas, licences or any other official purpose. Do not rely on a generated image where a true likeness is legally required.

3. Subscriptions and payment

Headshot Pro is offered as an auto-renewable subscription. The plan name, length and price are always shown on the purchase screen, in your local currency, before you confirm.

  • Payment is charged to your Apple ID account upon confirmation of purchase.
  • Your subscription renews automatically unless auto-renewal is switched off at least 24 hours before the end of the current period.
  • Your Apple ID account is charged for the renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
  • You can manage the subscription and switch off auto-renewal at any time in your Apple ID Account Settings after purchase.
  • If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
  • Prices may vary by country and may change; you will always be asked to confirm before a new price takes effect.
  • Fair use: AI generation runs on paid computing capacity, so a subscription includes a generous daily allowance of AI generations rather than an unmetered one. If you reach the allowance, the App tells you and it resets the next day. The allowance is set so that normal personal use is never affected, and we will tell you in the App before reducing it.

4. Cancellation and refunds

Cancelling stops future renewals; you keep access until the end of the period you have already paid for. Deleting the App does not cancel a subscription.

All purchases are processed by Apple, and refunds are handled by Apple under the App Store Terms of Sale. We cannot issue refunds directly, but we will gladly help you with a request - write to us at the address below.

5. Restoring purchases

Use "Restore" on any purchase screen, or Profile > Restore purchases, to recover an active subscription on a new device, provided you are signed in with the Apple ID that made the purchase.

6. Acceptable use

You may upload only photographs of yourself, or photographs of another person who has given you their explicit permission to use their image in this way. If you are below the age of majority where you live, use the App only with the involvement of a parent or guardian. You must not use the App to:

  • upload a photograph of another person without their permission, and in particular never a photograph of a child who is not in your care;
  • impersonate anyone, or create misleading or deceptive images of a real person, including images intended to be mistaken for genuine photographs;
  • produce sexual, nude, suggestive, violent, hateful, harassing, defamatory or otherwise unlawful content, or supply a reference garment intended to produce such content;
  • infringe anyone's intellectual property, privacy, publicity or personality rights;
  • attempt to circumvent the content safeguards, the technical limits, the authentication or the fair-use allowance of the App or its processing service, or to reverse engineer, decompile, scrape or resell any part of it.

We apply safeguards on our servers, and the generation instruction is fixed by us so that only wardrobe, background and lighting are changed. We may suspend or terminate access to the generation features where we detect a breach of this section. If you encounter a result you believe is inappropriate, report it to us at the address below and we will investigate.

7. Your content and your results

You keep all rights in the photographs you upload. You grant us only the limited, temporary licence needed to process a photograph in order to produce the result you asked for, and for no other purpose. We do not use your photographs to train AI models.

To the extent permitted by law, the images generated for you are yours to use, including commercially. You remain responsible for how you use them and for complying with the rules of any platform on which you publish them.

8. Availability and changes to the service

We aim to keep the App available and working, but features that rely on our processing service or on our model provider may be temporarily unavailable for maintenance or for reasons outside our control. We may modify or discontinue features. If a change materially reduces what a paid subscription offers, you may cancel and, where required by law, request a pro-rated refund through Apple.

9. Disclaimer and limitation of liability

The App is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law.

To the maximum extent permitted by applicable law, our total liability arising out of or relating to the App is limited to the amount you paid for the App in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

10. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your access if you materially breach these Terms, in particular section 6. Provisions that by their nature should survive termination - including sections 7, 9 and 11 - continue to apply.

11. Governing law and consumer rights

These Terms are governed by the laws of the Republic of Turkiye, without regard to conflict-of-law rules. If you are a consumer, you keep the benefit of any mandatory consumer-protection rules of the country where you live, and you may bring proceedings before your local courts.

12. Apple

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

13. Changes to these Terms

We may update these Terms. The "last updated" date reflects the version in force, and material changes will be announced in the App. Continuing to use the App after a change means you accept the updated Terms.
