Terms of Use for Migraine Tracker

These Terms of Use (“Terms”) govern your use of Migraine Tracker, developed by Furkan Kaya. By downloading or using the app, you agree to these Terms and Apple’s applicable App Store terms. If you do not agree, do not use the app.

1. Informational tool; no medical advice

Migraine Tracker is a personal diary, pattern-visualization, reminder, and educational tool. It is not a medical device and does not diagnose, prevent, monitor, or treat any disease. Risk scores, pressure warnings, correlations, reports, and educational content are estimates or general information and may be incomplete or inaccurate. Do not use the app as a substitute for a qualified health professional.

2. Emergencies and medication decisions

Do not delay professional or emergency care because of information in the app. Seek urgent medical assistance for a sudden severe headache, new neurological symptoms, or any situation you believe may be an emergency. Medication reminders are organizational aids only; always follow instructions from your clinician and pharmacist.

3. Eligibility and acceptable use

You must be legally able to agree to these Terms. You agree not to misuse the app, attempt unauthorized access, reverse engineer the app except where law expressly permits, interfere with its operation, or use it to violate another person’s rights.

4. Your data and responsibilities

You are responsible for the accuracy of entries, protecting access to your device, maintaining independent backups of important information, and reviewing exports before sharing them. You retain ownership of information you enter. You grant the app only the permission necessary to process that information on your device and provide requested features.

5. Subscriptions and billing

Migraine Tracker may offer auto-renewable weekly and annual subscriptions without a free trial. Prices and billing periods are shown in the App Store purchase sheet before confirmation. Payment is charged to your Apple ID account. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Apple may charge your account for renewal within 24 hours before the period ends. You can manage or cancel subscriptions in your Apple account settings. Refunds are handled by Apple under its policies. Deleting the app does not cancel a subscription.

6. Free and paid features

Features included in free and paid tiers may change over time. A valid purchase entitlement is required to access paid features. We may correct pricing, product, or entitlement errors, subject to applicable law and App Store requirements.

7. Availability and changes

The app is provided on an “as is” and “as available” basis. Weather, Apple Health, notifications, subscription verification, and other platform-dependent features may be delayed, unavailable, or limited by permissions, device support, connectivity, third-party services, or operating-system behavior. We may update, suspend, or discontinue features.

8. Intellectual property

The app, its design, code, illustrations, and original content are owned by Furkan Kaya or licensed to us and are protected by applicable intellectual-property laws. These Terms grant you a personal, limited, non-exclusive, non-transferable license to use the app.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, missed reminders, inaccurate forecasts, health decisions, or inability to use the app. Nothing in these Terms excludes rights or liability that cannot legally be excluded.

10. Termination

You may stop using the app at any time. We may restrict access if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.

11. Governing terms and changes

Applicable mandatory consumer laws remain unaffected. We may update these Terms as the app changes. Continued use after an effective-date update constitutes acceptance where permitted by law.
