IDGate - Terms
Effective date: October 12, 2026
These Terms of Use ("Terms") govern your download, access to and use of the IDGate – ID Scanner & Age Check mobile application and any related services (together, the "App"). The App is developed and provided by Furkan Kaya, trading as Kaya Apps ("Developer", "we", "us" or "our").
By downloading, installing or using the App, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you use the App on behalf of a business, "you" also means that business, and you confirm that you are authorized to accept these Terms on its behalf. If you do not agree, do not use the App and delete it from your device.
1. Eligibility and business use
The App is designed for businesses and their staff, such as bars, nightclubs, restaurants, liquor and convenience stores, dispensaries and event organizers. You must be at least 18 years old, or the age of majority where you live if higher, to use the App. If you let staff use the App on your behalf, you are responsible for making sure they follow these Terms and are properly trained.
2. What IDGate is — and what it is not
IDGate reads the PDF417 barcode on the back of US and Canadian driver's licenses and identification cards that follow the AAMVA standard, and the machine-readable zone (MRZ) of passports and identity cards that follow ICAO Doc 9303. It calculates the holder's age from the date of birth stored there and compares it, together with the expiration date, with the age rule you set. It also offers manual date-of-birth checks, re-entry alerts, ban and VIP lists, a people-inside counter and reports.
IDGate is a helper for your staff. It is not an identity verification service. In particular:
- IDGate does not verify that an ID is genuine and does not detect fake, altered or borrowed IDs. A fraudulent document can carry a barcode or MRZ that reads correctly, and that data may not match what is printed on the document.
- IDGate does not connect to any government, motor vehicle or law enforcement database and cannot tell whether an ID has been reported lost, stolen, suspended or revoked.
- Results depend on the data encoded by the issuer, on the condition of the card, on your device's date and time settings, and on the age rule and venue settings you choose. Barcodes and MRZ lines can be damaged, unreadable or encoded incorrectly, and text recognition can fail in poor light or glare. Some issuers use formats the App cannot read; documents without a barcode or MRZ can only be checked by typing the date of birth.
- Front check compares text read from the front of the ID with the barcode. It can miss differences and can report differences that do not exist.
- IDGate does not provide legal advice and does not tell you what the law requires in your location.
- We make no representation that the App qualifies as a "transaction scan device" or any other approved age-verification device under any law, or that using it gives you any legal defense.
You remain solely responsible for every admission, sale and service decision. Always look at the physical ID, compare the photo and description with the person presenting it, check security features and follow your venue's policies and the law. Never rely on the App alone.
3. Your responsibilities and legal compliance
You are responsible for complying with all laws, regulations and license conditions that apply to you, including laws on:
- the sale or service of alcohol, cannabis, tobacco, vaping products and other age-restricted goods, and entry to age-restricted venues;
- collecting, using, retaining, disclosing and securing information read from identity documents. Some laws restrict scanning or keeping such information — for example California Civil Code §1798.90.1 and Texas Transportation Code §521.126 — and privacy regulators in Canada and elsewhere have issued guidance on scanning IDs at venues;
- giving guests any notice and obtaining any consent the law requires;
- anti-discrimination and equal treatment.
Features that keep data (the scan log, the ban list and the VIP list) are off by default. Turn them on only where your use is lawful, keep data only as long as necessary, and delete it when it is no longer needed. You must not use the ban list, the VIP list or any other feature to discriminate unlawfully against any person, and you are responsible for the accuracy and fairness of every list entry. You must keep the device running the App secure, for example with a passcode and the optional Face ID lock.
4. Free scans and IDGate Pro
The App is free to download and includes a limited number of free scans, as shown in the App. Manual date-of-birth checks and the people-inside counter remain free. Unlimited scanning and additional features, such as continuous scanning, ban and VIP alerts, re-entry alerts, Front check, the scan log, reports and CSV export, require an IDGate Pro subscription. We may change which features are free and which require Pro.
5. Subscriptions, free trials and payments
IDGate Pro is an auto-renewing subscription purchased through Apple's App Store.
- Billing. Payment is charged to your Apple ID account when you confirm the purchase. Prices and billing periods (for example weekly or yearly) are shown in the App before purchase and may vary by country and change over time.
- Auto-renewal. Your subscription renews automatically at the end of each period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
- Free trials. If a free trial is offered, its length is shown on the purchase screen. When the trial ends, the subscription starts automatically and you are charged unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial is forfeited when you buy a subscription. Trial eligibility is determined by Apple.
- Special offers. Introductory or special prices are available only to eligible users, for a limited time and on the terms shown with the offer, including whether the price continues at renewal.
- Managing and cancelling. You can manage or cancel your subscription at any time in your device's Settings → [your name] → Subscriptions. Deleting the App does not cancel your subscription. Cancellation takes effect at the end of the current billing period, and you keep access to Pro until then.
- Refunds. All purchases are processed by Apple. We do not have access to your payment details and cannot issue refunds ourselves. Refund requests must be made to Apple at https://reportaproblem.apple.com and are subject to Apple's policies. Except where required by applicable law, payments are non-refundable and there are no refunds or credits for partial periods.
- Restoring purchases. You can restore an active subscription on another device signed in with the same Apple ID using "Restore" in the App.
- Changes. We may change the features included in Pro, add new paid features or change prices. Price changes for existing subscriptions are handled by Apple and notified to you as required by Apple and applicable law.
6. Your data and your device
Night counts, settings, the scan log, the ban list and the VIP list are stored only on your device. We do not offer accounts, cloud sync or cloud backup. If you delete the App, reset or lose your device, or choose "Delete all data", this data may be permanently lost and we cannot restore it. Exported reports are your responsibility once they leave the App. Please read our Privacy Policy for details on how data is handled.
7. License and acceptable use
Subject to these Terms, we grant you a personal or internal-business, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
You agree not to:
- copy, modify, translate, adapt or create derivative works of the App;
- reverse engineer, decompile, disassemble or try to extract the source code of the App, except where this restriction is prohibited by law;
- circumvent or interfere with subscriptions, free-scan limits, access controls or security features;
- use the App to collect, store or share information in violation of any law or anyone's rights, or to track, profile or harass any person;
- scan identity documents without a legitimate purpose such as checking age or entry eligibility;
- sell, rent, lease, sublicense or otherwise commercially exploit the App itself.
8. Intellectual property
The App and all of its content, including its design, text, graphics, icons, software and the "IDGate" name and logo, are owned by the Developer or its licensors and are protected by copyright, trademark and other laws. Nothing in these Terms transfers any ownership rights to you. Any feedback or suggestions you send us may be used by us freely and without any obligation to you.
9. Third-party services
The App relies on third-party services, including Apple (App Store, in-app purchases, camera, Vision and Face ID frameworks, and ratings) and Adapty (subscription management). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or their availability, and we are not responsible for any destination you choose when sharing exported reports.
10. Changes, availability and termination
We may update, change, suspend or discontinue the App or any feature, in whole or in part, at any time and without liability to you. We do not guarantee that the App will always be available, uninterrupted, error-free or compatible with every device, operating system version or ID format, or that it will read every ID. You may need to install updates to keep using the App.
We may suspend or terminate your license immediately, without notice, if you breach these Terms. You may stop using the App at any time by deleting it and cancelling any subscription through Apple. On termination, the license granted to you ends and you must stop using the App. Sections that by their nature should survive termination will survive, including sections 2, 3, 6, 8 and 11 to 17.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL RESULTS, AGES, ALERTS, REPORTS AND OTHER OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL READ EVERY ID, THAT ANY RESULT IS CORRECT, THAT THE APP WILL DETECT FRAUDULENT, ALTERED OR BORROWED DOCUMENTS, OR THAT USING THE APP WILL SATISFY ANY LEGAL OBLIGATION. YOU USE THE APP AT YOUR OWN RISK AND YOU ARE SOLELY RESPONSIBLE FOR YOUR ADMISSION, SALE AND SERVICE DECISIONS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR DATA, OR FOR ANY FINES, PENALTIES, LICENSE SUSPENSIONS OR REVOCATIONS, REGULATORY ACTIONS OR THIRD-PARTY CLAIMS, INCLUDING CLAIMS ARISING FROM ADMITTING, SERVING OR SELLING TO A MINOR OR REFUSING ANY PERSON, ARISING OUT OF OR IN CONNECTION WITH THE APP, ANY RESULT OR YOUR RELIANCE ON THEM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS (USD 50).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for gross negligence or willful misconduct.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless the Developer from any claims, damages, losses, fines, liabilities and expenses (including reasonable legal fees) arising from your use of the App, your admission, sale and service decisions, your collection, retention or disclosure of information about guests, your use of the ban or VIP lists, your violation of these Terms, or your violation of any law or the rights of any third party.
14. Apple-specific terms
These Terms are between you and the Developer only, not Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support services for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that the App infringes that third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary. Where these Terms are silent, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul, Türkiye. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, or of your right to bring proceedings in the courts of your country where the law gives you that right. Before starting any formal proceedings, please contact us so we can try to resolve the issue informally.
16. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date and, where the changes are material, we may also let you know in the App. Your continued use of the App after the changes take effect means you accept the updated Terms.
17. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a sale, merger or transfer of the App. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
